  • Mislead CreditDash and other users to acquire personal data or account information.
  • Submit false reports of abuse or misconduct.
  • Engage in automated use systems, such as using scripts to send comments or messages, or using any data mining, robots or similar data gathering and extraction tools.
  • Interfere or disrupt Site Services or functionality.
  • Falsely identify yourself as another user or attempt use the username of another user.
  • Transfer your profile.
  • Harass or abuse another person.
  • Circumvent security protocols designed to prevent or restrict access to the Site, or any portion of the Site.
  • Remove the copyright or other proprietary rights notice from any Service or Site Content.
  • Transmit content that contains any computer virus, worms, or other potentially damaging computer programs or files including, but not limited to viruses, Trojan horses, malware, clear graphics interchange formats (“gifs”), 1×1 pixels, web bugs, cookies or similar computer generated action intended to interferes with the CreditDash, Site, Services or other users.
  • Use, launch, develop or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper or offline reader that accesses the Site, or using or launching any unauthorised script or other software.

3. Cancellation:

You may cancel your subscription (if any) at any time. Your Cancellations will take effect at the end of the current paid term and there will be no pro-rated refunds. CreditDash may terminate this Agreement at any time and for any reason.

4. Privacy:

By accepting this Agreement, you expressly consent to our use of your personal information as explained in our Privacy Policy, which is incorporated herein by reference. This includes all personal information acquired from your Site registration and personal data entered in order to provide the criteria needed for optimal Services. 5. Not a credit repair service:

CreditDash is not a credit repair service. CreditDash merely provides the general consumer form letters addressed to the three credit bureaus containing publicly available credit reporting agency basic information and procedures to dispute legitimate inaccuracies and/or omissions.

6. Payment Obligations:

  • All payments shall be in U.S. dollars.
  • Sales tax will be added to the price of purchases as required by law or at CreditDash’s sole discretion for tax purposes.
  • You agree to pay all charges at the prices then in effect for your purchases, and you authorize us to charge your credit/debit card or payment provider.
  • You agree to provide complete payment information for all purchases.
  • You agree to immediately update your account and payment information, including billing address and zip code, email address, payment method, expiration dates where applicable.
  • If your purchase is subject to recurring charges, then you consent to us charging your payment method in advance on a recurring basis, without requiring your prior approval for each recurring charge. Recurring charges will continue until you notify us of your cancellation. Charges for renewal periods shall be calculated at the prevailing rates then offered by us
  • You will be responsible for all reasonable expenses for collections (including attorneys’ fees) for non-payment or late payment.
  • You agree to the use of electronic signatures and to electronic delivery of notices, policies and records of transactions. You hereby waive any rights or requirements under any statutes, regulations, rules, ordinances or other laws in any jurisdiction which requires an original signature or delivery or retention of non-electronic records, or to payments or the granting of credits other than by electronic means. Signatures and identities are not authenticated on the Site.

7. Governing law and venue:

Your use of the Site and the Services are governed by and construed in accordance with the laws of the State of Georgia, excluding such state’s conflicts of laws rules. Any legal action of whatever nature by or against CreditDash arising out of or related in any respect to the Site or the Services shall be brought solely in the applicable federal or state court located in or with jurisdiction over Gwinnett County, Georgia. You and we hereby consent to (and waive any challenge or objection to) personal jurisdiction and exclusive venue in such federal and state courts. In no event shall any claim, action or proceeding by you related in any way to the Site or the Services be instituted more than two (2) years after the cause of action arose. You will be liable for any attorneys’ fees and costs if we have to take any legal action to enforce these Terms of Use.

8. Limits on liability:

Except as limited by the laws of the United States of America or by the state of your domicile, you shall hold harmless CreditDash and its directors, employees and/or agents and such shall not be liable to you or any third party for any damages including, but not limited to indirect, punitive, special, incidental, consequential damage, attorneys’ fees and all related costs and expenses of litigation, arbitration or appeal. To the extent permitted by law, our liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us for the services during the six (6) month period prior to any cause of action arising.

  • Additionally, CreditDash is not liable for:
    • The contents of any communication, message, or other information sent by you to CreditDash.
    • Contents of any communication, message, or other information posted by you or other third parties on any part of the Site.
    • The contents of any website not controlled, owned, or operated by CreditDash that is linked to any part of the Site.
    • Any damages or injury caused by, including but not limited to, any Act of God, performance failure, error, omission, interruption, defect, delay, computer virus, or connection failure.
    • Any direct, indirect, incidental, special, or consequential damages arising out of or relating to use of or inability to use any of the Site or Services.

    • The Site may include links, with permission of CreditDash or not, to other Internet sites for various commonality or multi-tiered advertisements. CreditDash, is not responsible for or suggest endorsement of the content or availability of these sites or any particular, publications, individuals, companies or products not associated with CreditDash. CreditDash shall not be liable for any damages arising out of or in any way connected with your use or involvement with any product or service associated with third party sites. 9. Indemnification:

You agree to defend, indemnify and hold us harmless, including our subsidiaries and affiliates, and our respective officers, agents, partners and employees, from and against, any loss, damage, liability, claim or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your use of the Site or the Services; (2) a breach of these Terms of Use; (3) any breach of your representations and warranties set forth in these Terms of Use; or (4) your violation of the rights of a third party, including but not limited to, intellectual property rights. Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims. We will use reasonable efforts to notify you of any such claim, action or proceeding which is subject to this indemnification upon becoming aware of it.

Although we perform regular routine backups of data, you are primarily responsible for all data that you have transferred or that relates to any activity you have undertaken using the Services. You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of such data.

11. Updates and Modifications:

We reserve the right to correct any errors, inaccuracies or omissions and to change or update the information at any time, without prior notice. If there is any conflict between these Terms of Use and the Additional Terms, the Additional Terms will control for that Service, unless the Additional Terms expressly state that these Terms of Use will control.

12. Intellectual property:

All content, including, but not limited to software copyrights, source code, functionality, databases, Site designs (text, graphics, photographs, audio, video), generated letters, trademarks, trade dress, service marks, logos, patents except that which is specifically designated as owned by a third party author or developer are either owned by CreditDash or licensed to us, and are therefore protected by copyright, trademark or patent laws and other intellectual property rights and unfair competition laws of the United States, foreign jurisdictions and international conventions (“Intellectual Property”).

  • No Intellectual Property may be copied or reproduced and distributed, sold, licensed or otherwise exploited for any commercial purposes or personal favour to another without our express prior written permission. You agree that the Services you purchase, copied or download may only be used by you for your personal use.
  • You are granted a limited license to access and use the Site and Services.
  • We reserve all rights not expressly granted to you in the Site, Intellectual Property and Services.

You hereby irrevocably license to CreditDash and CreditDash is free to use at their discretion, any content you provide to the Site or otherwise, whether in the form of reviews, suggestions, ideas, comments, discussions, posts, displays, broadcasts, materials, audio or video, photographs etc., that you make viewable by CreditDash, other users or the general public. CreditDash is not responsible and assumes no liability for user generated content. By submitting your email address in connection with any review, you agree that CreditDash may use your email address to contact you about your review.

CreditDash, and Services provided are not guaranteed to MEET YOUR REQUIREMENTS or the results you wish to obtain through use of the Site of Services or Site Content. The Services and Site Content are provided to you on an “as is” basis. CreditDash expressly disclaims all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. THERE IS NO SUBSTITUTE FOR SOUND LEGAL ADVICE FROM AN ATTORNEY.
